1. Acceptance of Terms
By booking, reserving, or utilizing any transportation service provided by Elite Executive Limos Inc (the “Company”), the client (“Client”, “You”, or “Passenger”) acknowledges that they have read, understood, and agreed to be bound by these Terms and Conditions of Service (“Agreement”).
This Agreement constitutes a binding legal contract between the Client and the Company.
2. Scope of Services
The Company provides chauffeured ground transportation services, including but not limited to airport transfers, private charters, event transportation, and corporate travel.
All services are subject to vehicle and chauffeur availability. The Company reserves the right to assign an equivalent or upgraded vehicle at its discretion.
3. Reservations and Confirmation
- Reservations must be made in advance via the Company’s official website, telephone, or authorized representatives.
- A valid credit card or approved corporate account is required to confirm any booking.
- The Company reserves the right to refuse or cancel any reservation at its discretion, including in cases of suspected fraud, payment issues, or policy violations.
4. Rates, Fees, and Payment
- Rates are based on vehicle type, service duration, distance traveled, and applicable surcharges.
- The Client authorizes the Company to charge all agreed-upon fees to the provided payment method.
- Additional charges may apply, including but not limited to:
- Waiting time beyond the complimentary grace period
- Tolls, parking, or entrance fees
- Extra stops, route deviations, or service extensions
- Cleaning or damage fees resulting from passenger negligence or misconduct
- All amounts are due immediately upon completion of service unless otherwise stated in writing.
- Late payments may incur interest at the maximum rate permitted by law.
5. Cancellations and No-Show Policy
- Cancellations must be received in writing or confirmed by phone.
- Cancellation notice requirements:
- Sedan and SUV services: minimum 24 hours before scheduled pickup
- Stretch limousines, vans, and specialty vehicles: minimum 48 hours before scheduled pickup
- Cancellations received after the required notice period or failure to appear at pickup time will result in a full service charge (100% of the total fare).
- Refunds, if applicable, will be processed within seven (7) business days.
6. Delays and Service Interruptions
The Company shall not be liable for delays or service interruptions caused by circumstances beyond its control, including but not limited to weather conditions, traffic congestion, road closures, mechanical issues, accidents, strikes, or governmental actions.
Reasonable efforts will be made to minimize disruptions and inform the Client promptly.
7. Passenger Conduct and Vehicle Use
- Smoking, vaping, and the use of illegal substances are strictly prohibited in all Company vehicles.
- The Client is responsible for the conduct of all passengers.
- The Client shall be held liable for any damage to the vehicle caused by passengers.
- The chauffeur may terminate service without refund if passengers engage in illegal, unsafe, or threatening behavior.
8. Liability and Limitation of Damages
- The Company’s total liability for any claim shall not exceed the amount paid for the specific service.
- The Company is not responsible for lost, stolen, or damaged personal property left in vehicles.
- The Client agrees to indemnify and hold harmless the Company, its officers, employees, affiliates, and subcontractors from any claims arising from misuse of services or violation of this Agreement.
9. Safety and Compliance
All chauffeurs are properly licensed and insured in accordance with applicable state and federal laws. Vehicles are routinely inspected and maintained.
All passengers are required to wear seat belts at all times, as mandated by law.
10. Privacy and Data Protection
The Company collects and processes personal information solely for the purpose of providing and managing transportation services.
Personal data will not be sold or disclosed to third parties except as required by law or with the Client’s consent. Please refer to our Privacy Policy for further details.
11. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles.
Any dispute arising out of this Agreement shall be subject to the exclusive jurisdiction of the courts located in Miami-Dade County, Florida.
12. Modifications
Elite Executive Limos Inc reserves the right to modify these Terms and Conditions at any time without prior notice. Updated terms will be posted on the Company’s website.
Continued use of the services constitutes acceptance of any revised Terms.
13. Entire Agreement
This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements, communications, or representations, whether written or oral.
